Спостерігачі ОПОРИ в Чернівцях за останні чотири місяці зафіксували іміджеві публікації та публікації з ознаками чорного піару у регіональних ЗМІ про потенційних кандидатів у президенти та їхні партії. Такі матеріали опубліковані без відповідного маркування та можуть мати ознаки прихованої політичної реклами.
З початку серпня до 20 листопада включно спостерігачі Громадянської мережі ОПОРА проаналізували наявність політичної реклами в друкованих медіа, інтернет ЗМІ, обласних радіо та каналах. Було зафіксовано близько 300 матеріалів, що можуть мати ознаки прихованої політичної реклами. 17% цих матеріалів містили ознаки чорного піару.
Найбільше позитивних матеріалів так і матеріалів з ознаками чорного піару стосуються Юлії Тимошенко – 97 і 18 відповідно. У Петра Порошенка співвідношення 43 до 7. У Арсенія Яценюка 36 до 9. Про 8 з 16 кандидатів матеріалів з ознаками чорного піару виявлено не було.
Виборча кампанія офіційно ще не стартувала, тому дані матеріали не можуть вважатися політичною агітацією. Офіційно виборча кампанія розпочнеться 31 грудня цього року, а самі вибори Президента України відбудуться 31 березня 2019 року.
ОПОРА нагадує, що поширення прихованої реклами забороняється українським законодавством, яке передбачає захист споживачів реклами від прихованої реклами. У Законі України «Про рекламу» (стаття 9, пункт 3) це питання регулюється так:
Інформаційний, авторський чи редакційний матеріал, в якому привертається увага до конкретної особи чи товару та який формує або підтримує обізнаність та інтерес глядачів (слухачів, читачів) щодо цих особи чи товару, є рекламою і має бути вміщений під рубрикою «Реклама» чи «На правах реклами». А в пункті 5 цієї статтізазначено: «Прихована реклама забороняється.
