Невідомі особи розмалювали рекламні конструкції на вул. Героїв Майдану в місті Чернівці. На них була розміщена політична реклама Юлії Тимошенко – кандидатки на пост Президента України та Володимира Зеленського – потенційного кандидата на цей же пост. На сітілайтах була намальована зірка Давида, а на рекламі Юлії Тимошенко ще були антисемітські написи.
Факт пошкодження сітілайтів 28 січня зафіксували спостерігачі ОПОРИ у Чернівцях та подали відповідну заяву в поліцію (щодо статті 161 Кримінального кодексу України). Також слід зазначити, що сітілайти, які були пошкоджені, не містили вихідних даних, що може розцінюватися як порушення ЗУ «Про вибори Президента України» (стосується Юлії Тимошенко, яка є зареєстрованим кандидатом в Президенти і на яку поширюється даний закон як на суб’єкта виборчого процесу). А саме ч. 3 ст. 59 Закону, у якій йдеться про те, що друковані матеріали передвиборної агітації повинні містити вихідні відомості про установу, що здійснила друк, або вказівку щодо використаного обладнання, їх тираж, інформацію про відповідальних за випуск та замовника. А також ч. 16 ст. 64 Закону, що містить заборону виготовлення та розповсюдження передвиборчих агітаційних матеріалів, що не містять цих даних.
ОПОРА звернулася до представників політичної партії ВО Батьківщина, аби з’ясувати, як вони збираються реагувати на подібні випадки псування сітілайтів.
Заступниця голови Чернівецької обласної партійної організації ВО Батьківщина Оксана Пантелеймонова зазначила:
Написи антисемітського спрямування на сітілайті з зображенням кандидата в президенти України від партії ВО «Батьківщина» ми сприймаємо як спробу дискредитації нашого кандидата і як розпалювання міжнаціональної ворожнечі. Глибоко засуджуємо такі явища, їх замовників і виконавців. Це неприпустимо. Вкотре закликаємо політиків до чесної боротьби. Ми вже звернулися до власників цих рекламних площ, щоб вони якнайшвидше усунули ці пошкодження.
Подібного роду надписи мають явні ознаки антисемітизму і ймовірно спрямовані на розпалювання міжнаціональної ворожнечі, адже люди, які їх зробили, явно хотіли прив’язати кандидатів на пост Президента України до певних етнічних груп і висвітлити їх в негативному ключі. Зірка Давида є символом єврейського народу і сама по собі не носить негативного забарвлення, проте саме шестикутну зірку (“Лата”) в період Голокосту нацисти використовували як знак ганьби для означення євреїв в громадських місцях і їх сегрегації. Символічно також те, що подібні надписи з’явилися в Міжнародний день пам’яті жертв Голокосту. Вважаю неприпустимим використання подібних методів у політичній боротьбі, тому поліція повинна визначити осіб, які вдалися до такої діяльності та встановити мотиви їхнього злочину,
– зазначає Тарас Прокоп, координатор спостереження Громадянської мережі ОПОРА за виборами у Чернівецькій області.
Радниця з юридичних питань Громадянської мережі ОПОРА Тетяна Юзвяк вказує, що є неприпустимим розміщувати написи, інформація в яких містить заклики до розпалювання міжетнічної, расової, релігійної ворожнечі (ст. 28 Закон України «Про інформацію»). Статтею 161 Кримінального кодексу України передбачено відповідальність за умисні дії, спрямовані на розпалювання національної, расової чи релігійної ворожнечі та ненависті, на приниження національної честі та гідності, або образу почуттів громадян у зв’язку з їхніми релігійними переконаннями, а також пряме чи непряме обмеження прав або встановлення прямих чи непрямих привілеїв громадян за ознаками раси, кольору шкіри, політичних, релігійних та інших переконань, статі, інвалідності, етнічного та соціального походження, майнового стану, місця проживання, за мовними або іншими ознаками.
У даній справі слід встановити осіб, які здійснили ці написи, з’ясувати їх мотиви та умисел, дослідити контекст та мовно-стилістичне вираження таких написів, а за результатами вирішити питання про притягнення винних до відповідальності.
