У Чернівцях спостерігачка Громадянської мережі ОПОРА зафіксувала випадок збору персональних даних в агітаційному наметі партії «Самопоміч» для підписки на їхню газету. При цьому людям не роз’яснюється, кому такі персональні дані потім будуть передані, як і хто їх в подальшому зберігатиме та використовуватиме.
За коментарем представники ОПОРИ звернулися до голови обласного штабу політичної партії «Самопоміч» Олега Мельничука, який підкреслив, що ці дані беруть у людей виключно для того, щоб оформити підписку на газету.
Юридична радниця Громадянської мережі ОПОРА Тетяна Юзвяк звертає увагу, що відповідно до ст. 2 Закону України «Про захист персональних даних» персональними даними є відомості чи сукупність відомостей про фізичну особу, яка ідентифікована або може бути конкретно ідентифікована. Згідно ч. 2 ст. 11 Закону України «Про інформацію» до конфіденційної інформації про фізичну особу належать, зокрема, дані про її національність, освіту, сімейний стан, релігійні переконання, стан здоров’я, а також адреса, дата і місце народження. Відповідно до ч. 5, 6 ст. 6 цього ж Закону не допускається обробка даних про фізичну особу, які є конфіденційною інформацією, без її згоди, крім випадків, визначених законом, і лише в інтересах національної безпеки, економічного добробуту та прав людини.
Таким чином, до персональних даних належить інформація про прізвище, ім’я та по-батькові особи в сукупністю з адресою та телефоном особи. Такі дані можуть бути передані лише за згодою особи і мета збору таких даних, способи їх подальшого використання, мають бути відомі особі.
Зважаючи на це, закликаємо суб’єктів виборчого процесу дотримуватися вказаних норм закону при зборі від виборців ї персональних даних, а самих виборців відповідально ставитися до передачі своїх персональних даних третім особам, завжди вимагати пояснити, як і ким будуть використовуватися їх персональні дані, з якою метою та протягом якого терміну,
