Відповідно до розпорядження міського голови у Чернівцях визначили 61 місце для розміщення друкованих матеріалів передвиборчої агітації.
Згідно з календарним планом підготовки проведення виборів, ще до 30 грудня місцеві органи виконавчої влади, органи місцевого самоврядування мали обладнати стенди, дошки оголошення у людних місцях для розміщення друкованих матеріалів передвиборчої агітації.
Комунікаційниця ОПОРИ звернулася із запитом на інформацію до Чернівецької міської ради із проханням надати дані про виконання частини 4 статті 59 Закону України «Про вибори Президента», у якому є перелік визначених місць для агітації у місті.
В Чернівцях 28 грудня 2018 року згідно з розпорядженням міського голови такі місця були затверджені. В обласному центрі виділено 61 місце для встановлення стендів під розміщення агітаційних матеріалів з проведення виборів Президента України 31 березня 2019 року.
Згідно з Додатком 2 до розпорядження Чернівецького міського голови більшість місць визначені біля зупинок міського транспорту, магазинів та ринків. Також спостерігачі ОПОРИ найближчий часом здійснять моніторинг локацій, що закріплені міською радою як місця для проведення політичної агітації у Чернівцях.
«Хочемо застерегти представників передвиборчих штабів кандидатів на пост Президента від розміщення агітації у невідведених для цього місцях, а у випадку виявлення таких випадків, наші спостерігачі будуть звертатися до компетентних органів»,
– зазначає Тарас Прокоп, координатор спостереження Громадянської мережі ОПОРА за виборами у Чернівецькій області.
Радниця з юридичних питань Громадянської мережі ОПОРА Тетяна Юзвяк нагадує, що відповідно до ч. 4 ст. 59 Закону України «Про вибори Президента України» місцеві органи виконавчої влади, органи влади Автономної Республіки Крим, органи місцевого самоврядування не пізніш як за дев’яносто днів до дня виборів відводять місця та обладнують стенди, дошки оголошень у людних місцях для розміщення матеріалів передвиборної агітації. За розміщення агітації у не відведених для цього місцях настає відповідальність, передбачена ст. 152 Кодексу України про адміністративні правопорушення «Порушення державних стандартів, норм і правил у сфері благоустрою населених пунктів, правил благоустрою територій населених пунктів».
При розміщенні агітаційних матеріалів слід пам’ятати, що забороняється виготовлення та розповсюдження друкованих передвиборних агітаційних матеріалів, що не містять відомостей про установу, яка здійснила друк, їх тираж, інформацію про осіб, відповідальних за випуск, та замовника відповідних матеріалів (ч. 16 ст. 64 цього ж Закону). Порушення цього правила має наслідком притягнення до адміністративної відповідальності за ст. 212-13 КУпАП «Виготовлення або розповсюдження друкованих матеріалів передвиборної агітації, які не містять відомостей про установу, що здійснила друк, їх тираж, інформацію про осіб, відповідальних за випуск». Закон суворо забороняє розміщувати агітацію на пам’ятках архітектури, а також у місцях, де вони перешкоджають безпеці дорожнього руху, а також на будинках і в приміщеннях органів державної влади, органів влади Автономної Республіки Крим та органів місцевого самоврядування, підприємств, установ і організацій державної та комунальної форм власності (ч. 14 та ч. 21 ст. 64 Закону). Вказані порушення підпадають під дію ст. 212-14 КУпАП «Порушення порядку розміщення агітаційних матеріалів чи політичної реклами або розміщення їх у заборонених законом місцях».
