Спостерігачі ОПОРИ в Чернівцях зафіксували розміщення зовнішньої реклами з ознаками порушення чинного законодавства Юлії Тимошенко, Олега Ляшка, Дмитра Добродомова, Олександра Шевченка та Анатолія Гриценка. На підставі отриманих даних вони звернулися до правоохоронних органів з вимогою притягнути порушників до адміністративної відповідальності. Представники регіональних осередків партії зазначили, що відношення до зовнішньої реклами кандидатів не мають, бо її замовляє центральний офіс.
Рекламу зафіксували у Шевченківському та Садгірському районах міста. Зазначені білборди, сітілайти та листівки не містять визначених чинним законодавством обов’язкових атрибутів для друкованих агітаційних матеріалів – вихідних даних (відомостей про установу, що здійснила друк, їх тираж, інформацію про осіб, відповідальних за випуск).
26 січня спостерігачка ОПОРИ виявила білборд із написом «Зможемо! Дмитро Добродомов» без вихідних даних. Окрім того, спостерігачі виявили поширення агітаційної продукції кандидата на пост Президента Дмитра Добродомова, на якій також не зафіксовано вихідних даних.
Представник осередку партії Народний контроль Михайло Яринич у коментарі ОПОРІ зазначив, що зовнішньою рекламою займається центральний офіс в Києві, тому прокоментувати дану ситуацію він не може.
27 січня спостерігачі виявили на вул. Комарова білборди з написом «Ляшко народний Президент» та «2019 рік народної допомоги» без вихідних даних. Голова міської організації Радикальної партії Олега Ляшка Орест Богдан зазначив, що білборди розміщувала київська організація партії, вони були встановлені за місяць до виборів. Коли закінчиться строк оренди рекламних місць, то їх поновлять на нові.
Того ж дня на вул. Головній спостерігачі зафіксували білборд з написом «Вірю в Україну! Юлія Тимошенко 2019», що не містив вихідних даних.
Заступниця голови Чернівецької обласної партійної організації ВО «Батьківщина» Оксана Пантелеймонова зазначила:
Чернівецькій обласній організації партії ВО «Батьківщина» нічого не відомо про зображення лідера партії ВО «Батьківщина» Юлії Тимошенко на білбордах на території Чернівецької області, про які йдеться у Вашому запиті. Ми не є замовниками розміщення політичної реклами на цих рекламних площах і діємо тільки в рамках чинного законодавства. На жаль, іншої інформації і, відповідно, коментарів ми не маємо.
29 січня в Садгірському районі виявлено 2 білборди з написом «Прибрати порох з нашої оселі. Олександр Шевченко». Голова обласного штабу Віталій Ткачук відповів, що обласний осередок партії до зовнішньої реклами кандидата не має відношення. І що їм навіть точно невідомо, де саме вона розташована.
Також на вул. Комарова зафіксовані сітілайти з написом «Чесні у владі – гідне життя людей. Анатолій Гриценко» без вихідних даних. Відповіді від представників кандидата щодо цього випадку на момент виходу матеріалу ОПОРА не отримала.
Нагадуємо, що 25 січня ЦВК зареєструвала Юлію Тимошенко, Олега Ляшка та Дмитра Добродомова кандидатами на пост Президента України. Олександр Шевченко зареєстрований кандидатом з 21 січня, а Анатолій Гриценко з 15 січня.
За словами юридичної радниці Громадянської мережі ОПОРА Тетяни Юзвяк, відсутність маркування на білбордах свідчить не лише про недотримання вимог закону щодо наявності вихідних даних, а й може вказувати на фінансування вказаної зовнішньої реклами не за рахунок коштів виборчого фонду кандидатів, що також є порушенням.
ОПОРА нагадує, що згідно з частиною 16 статті 64 цього ж Закону, забороняється виготовлення та розповсюдження друкованих передвиборних агітаційних матеріалів, що не містять відомостей про установу, яка здійснила друк, їх тираж, інформацію про осіб, відповідальних за випуск, та замовника відповідних матеріалів. За розповсюдження та організацію розповсюдження таких матеріалів настає відповідальність за частиною 2 статті 212-13 Кодексу України про адміністративні правопорушення, що має наслідком накладення штрафу на громадян від 51 до 85 гривень і на посадових осіб – від 340 до 510 гривень.
Згідно ч. 2, 3 ст. 37 Закону України «Про вибори Президента України» кандидат на пост Президента України, зареєстрований Центральною виборчою комісією, для фінансування передвиборної агітації зобов’язаний утворити свій виборчий фонд, що формується в порядку, встановленому цим Законом. Фінансування передвиборних агітаційних заходів чи матеріалів передвиборної агітації з джерел, не передбачених частиною другою цієї статті, незалежно від наявності погодження з партіями – суб’єктами виборчого процесу чи кандидатами на пост Президента України, забороняється.
Відповідно до ст. 212-15 Кодексу України про адміністративні правопорушення порушення встановленого законом порядку надання або отримання фінансової (матеріальної) підтримки для здійснення передвиборної агітації – тягнуть за собою накладення штрафу на громадян від 1 190 до 1 700 гривень і на посадових осіб – від 1 700 до 2 210 гривень з конфіскацією суми внеску на підтримку політичної партії, наданої або отриманої з порушенням закону.
